Amendment C173 and C175 - Interim Heritage Overlay

West Footscray and Surrounds Heritage Precincts 

Current status

The interim heritage overlay introduced by Amendment C173 on 10 December 2021 has recently been amended through Amendment C175 on 6 June 2022.

Amendment C173 - introduction of interim heritage overlay

Amendment C173 introduces interim heritage overlays to eight precincts identified in the West Footscray Inter-war and Post-war Heritage Study while an amendment for permanent heritage protection is progressed through Amendment C172.

The interim heritage protection has been introduced for the precincts to prevent erosion of local heritage whilst the permanent protection is being considered. The interim heritage protection came into operation on 10 December 2021 for a period of one year.

Council is seeking permanent heritage protection for precincts identified with local heritage significance, as outlined on the Amendment C172 webpage

Council notified property owners of the approval of interim heritage protection in December 2021 and gave advance notice that a formal public exhibition process for permanent heritage protection will occur via Amendment C172.

Amendment C175 - update to interim heritage overlay 

Subsequent to the gazettal of Amendment C173, Council and the Department of Environment, Land, Water and Planning have identified a number of properties that have existing permits for development (including demolition) that were granted prior to Amendment C173 coming into effect and were unable to be acted upon without further consents being obtained from the council.

As a consequence, the Minister for Planning has approved Amendment C175 which removes nine properties from the interim heritage overlay. Please refer to the Explanatory Report below for further details.

The properties removed from the interim heritage overlay are still affected by the Amendment C172 process which seeks to apply a permanent heritage overlay to the land.

Amendment C175 came into effect on 6 June 2022.
