Learn to Swim Membership Terms and Conditions
These conditions comprise the entire agreement between the parties in relation to its subject matter and supersede and replace any previous agreement or arrangement between the parties in relation to its subject matter.
MAC LTS reserves the right in its sole discretion to vary these conditions by providing you with one month’s advance notice of any variation.
The notice may be provided by any reasonable communication method, including but not limited to Maribyrnong City Council’s website, social media channels, email, letter, SMS or signage.
MAC LTS program operates according to the Victorian Public School Terms. MAC LTS does no operate on public holidays. No lessons will take place on these days or during the noted holiday breaks based on the Victorian Public Schools Terms. The Swim School membership remains active on public holidays and can be used to access the Centre. The MAC LTS calendar is available on the website.
MAC LTS Membership includes a weekly lesson 28min/58min (dependent on class level) during school terms, access to pools during all operating hours throughout the year, and a MAC Parking Pass to the MAC carpark to enable extended parking.
Missed lessons – there are no make-up lessons, credits or refunds for missed lessons as the membership allows the student access to pools at all times.
The responsible person on the account is the only person permitted to make changes to the class or account unless the responsible person authorises another person.
Children under the age of 10 must be accompanied to and collected from their LTS Teacher by a parent or guardian aged 16 years or older at the beginning and end of each lesson.
Swimming lessons may be moved or cancelled at short notice in the event of a situation occurring that poses a safety risk.
MAC reserves the right to ask a customer to leave and/or cancel their enrolment if any member, parent or guardian fails to comply with these terms and conditions.
LTS Students under 18 must have a financially responsible person for the membership account
The MAC LTS membership allows unlimited access to the leisure and 50m/25m pools during all opening times for enrolled students, including school holidays and public holidays. Note, students over 16 years of age may also access the warm water pool.
It is the responsibility of the enrolled student or their parent guardian to ensure the access wristband (RFID) is presented and scanned for every student upon each visit to the Centre. This allows access for pool use only for the enrolled student.
Each enrolled LTS student under 16 is permitted a supervising parent/guardian to access the pool hall with them; however, unless the LTS student is under 5 years of age, the supervising adult is required to pay the applicable fee prior to entry if they want to enter the pool themselves.
A responsible person cannot access the Centre without the enrolled LTS student being present.
It is a condition of entry to MAC that all children must be accompanied by a parent or guardian whilst at the Centre. Participants under the age of 10 will not be accepted into lessons if their parent or guardian is absent.
LTS parents and guardians are required to actively supervise their children at all times within the Centre, including during class time.
Children under 5 years:
- 0-4 years must wear a PINK wristband
- Must be accompanied into the Centre and the water by a responsible guardian over 16 years
- Must stay within arm’s reach at all times, which includes children in prams
- A maximum of two under 5s can be supervised by one guardian over 16 years
- Guardians must wear the corresponding number of PINK wristbands to match to their child/children at all times
Children under 10 years:
- 5-9 years must wear a YELLOW wristband
- Must be accompanied into the Centre by a responsible guardian over 16 years old
- Must be constantly and actively supervised
- Guardians must position themselves to have a clear view of the child with no physical or structural barriers between them and the child/children, which includes the use of electronic devices, e.g. mobile phones and laptops.
- A maximum of four under-10s can be supervised by one guardian over 16 years - a maximum of two under 5s may be included in this number
- guardians must wear the corresponding amount of YELLOW wristbands to match to their child/children at all times
Children 10 years old and over
Guardians must use their knowledge of an individual child’s swimming ability and general development to determine the level of accompaniment required.

4. Payment of Fees & Direct Debit
LTS Memberships are made by direct debit only. Direct debit can be made from a bank account or credit card and will occur fortnightly in line with the direct debit calendar available from Customer Service.
Payments are made in advance before the next debit date.
Depending on your bank, payments may take up to five (5) business days to be processed.
You agree to pay the instalment amount at the agreed payment frequency until your membership is formally cancelled.
To help you understand your rights and responsibilities when making repayments by direct debit, please see the below.
You are responsible for ensuring:
- Your nominated account is set up to accept our direct debit. If you are uncertain about this, please check with the financial institution where your account is held.
- There is enough money in your nominated account on the direct debit due date and up to 5 business days following. Note, there may be a delay in processing the direct debit if there is a public holiday on the day of the debit.
- You inform the MAC Customer Service Team if your bank or credit card details change.
Price changes occur annually. Price increases will be advised 28 days before the first increased payment is due.
If a debit is returned unpaid by your Financial Institution, we will require you to pay the outstanding money on site by cash/EFTPOS or the MAC Online Client Portal. Alternatively, fees will be rolled over on the following debit. A rejection fee applies to each unsuccessful debit.
Any failed payments may result in the immediate restriction of access to MAC until all outstanding monies have been finalised
6. Concession/pensioner discounts
Valid concession/pensioner card details must be provided for the student and/or responsible person to MAC Customer Service at the time of enrolment to receive the subsidised fee.
It is the concession/pensioner card holder’s responsibility to provide new concession card expiry details. If not provided prior to expiry, a full rate will be charged. Concession/pensioner rates cannot be backdated.
7. Cancellation of LTS Membership
All enrolments are perpetual (ongoing), and the direct debit payments will continue until a completed cancellation form is submitted by you.
Before the LTS Membership can be cancelled, a cancellation form must be completed in full, fourteen (14) days before the requested end date and submitted to MAC Customer Service or emailed to: macmembership@maribyrnong.vic.gov.au
Cancellations will not be granted until outstanding amounts owed are paid in full.
Written notice of cancellation of LTS Membership will be sent by email.
8. Cancellation after Dishonoured payment
MAC LTS reserves the right to cancel enrolments where outstanding amounts exceed fourteen (14) days in arrears.
MAC LTS will cancel memberships following three (3) failed payments.
If you receive written notice of termination and you do not wish your enrolment to be cancelled, you will need to contact the Customer Service Team at MAC immediately to pay your outstanding balance.
Should your agreement be terminated, MAC will continue to pursue the amount owed until settlement is made. If you wish to re-enroll after your account has been settled, we are unable to guarantee your original lesson booking time and day.
No freezes are available on this Membership except over the Christmas break. The dates for the Christmas break will be advised via the MAC eNews. Students wishing to opt out of swimming lessons during this period must contact MAC customer service by the date advertised in the MAC eNews. If a freeze is selected for either 2 or 4 weeks, all membership entitlements are suspended during this period.
The LTS membership will automatically reactivate at the end of the freeze period.
There are no makeup lessons, credit or refunds for missed lessons as the enrolment allows the student access to pools during all opening hours.
If a student misses three (3) classes in a row, you will receive notification confirming you would still like to continue in your allocated class. If you miss six (6) lessons in a row you will be automatically cancelled unless contact has been made via email or phone call.
Credits may apply to a student who has incurred a medical illness or injury for more than two (2) consecutive weeks; a medical certificate is required as supporting evidence, and any eligible credits are calculated from the specific dates provided on the evidence. Medical certificates must be emailed to macmembership@maribyrnong.vic.gov.au , within six (6) weeks of receiving this from your doctor
All credits and refunds are subject to approval. They are not automatically granted and are at the discretion of Management. Refunds, if granted, may take up to four (4) weeks to process and are calculated from the date of application. Refunds on membership accounts will only be considered where:
A medical condition precludes further participation and is supported by a medical certificate; or
- The applicant relocates more than 10km from the Centre and provides proof of relocation.
- Credits or Refunds will not be granted for missed lessons before written notification.
The 7-day cooling-off period will commence at the close of business on the date of signing this contract. During the 7-day cooling-off period a full refund will be provided for the purchase of this membership. The refund may take up to 60 days to process.
Parent/Guardian can apply for a parking pass to park for up to 4 hours in the MAC Carpark. Please read all of the information about the MAC Parking Pass carefully to avoid parking infringements. MAC is not responsible for any parking infringements incurred.
You declare that you/your children are physically capable of and there is no medical reason to prevent you/them from proceeding with the use of Maribyrnong City Council facilities without endangering your/their health. You acknowledge that whilst on Maribyrnong City Council premises, you, your children, your property and your children’s property are at your own risk.
b) You acknowledge that you will not hold Maribyrnong City Council responsible for and Maribyrnong City Council hereby excludes, to the extent permitted by law, all liability for any personal injury or damage (whether direct, indirect special or consequential) suffered by you or your children or loss of property while on Maribyrnong City Council premises or arising in any way out of the use of the facility and equipment provided by MAC, however that injury, damage or loss is caused, except to the extent that Maribyrnong City Council has omitted to exercise due care and skill. You acknowledge that except as provided in this document, Maribyrnong City Council gives no warranties in respect of the facilities and equipment it provides. You release and will indemnify and keep indemnified Maribyrnong City Council for any injury or loss suffered by your children or you whilst on Maribyrnong City Council premises.
You consent to receiving any medical treatment that MAC LTS reasonably considers necessary or desirable for you during participation in the swim lesson. You also agree to reimburse MAC for any costs or expenses incurred in providing you with medical treatment.
16. Sickness and Communicable Diseases
Please respect our precautionary health rules and refrain from attending lessons if your child is suffering from any contagious disease (e.g., COVID-19, conjunctivitis, rubella, flu, gastro, fever, common cold, runny or infected noses, sore throats, cold sores, ringworm, head lice, or urinary tract infections).
If there is any risk, however small, to other users, please avoid visiting MAC.
Please avoid swimming at MAC for the following durations if you contract any of the diseases listed below:
- Chickenpox – Wait 7 days after rash appears
- Cryptosporidiosis (crypto) – Wait 2 weeks after diarrhea stops
- Tinea (athlete’s foot) – Wait 1 day after starting treatment
- Measles – Wait at least 4 days after rash appears
- Flu – Wait until fully recovered
- Ringworm or head lice – Wait 1 day after treatment begins
- Hand, foot, and mouth disease – Wait until all blisters have dried
17. Appropriate Clothing, Aqua Nappy and Swim Caps
All students who are not fully toilet trained must wear the correct form of aqua nappy if swimming in a public facility. Please ensure that students are suitably attired if they fall into this category for the comfort and safety of all patrons. We also require appropriate swimwear to be worn at all times (no underwear). We recommend swim caps be worn for all lessons. Swim caps are available for purchase at reception.
If you are unsure of what is deemed appropriate swimwear, please speak with the customer service team.
Swim School reserves the right to cancel or change classes, locations and instructors or move students if the need arises. Changes will not be made unnecessarily. The swim school will communicate any changes to you in advance whenever possible.
MAC is a family-friendly Centre and we have a zero-tolerance approach to bullying, harassment or intimidation of staff or other patrons. MAC staff are committed to making your learn to swim experience a positive and enjoyable one. When in the Centre, please treat staff respectfully and follow any directions given. At any time that you have concerns, please speak to a staff member who will be happy to assist you. Acts of aggression, swearing, or damage to property may result in you being removed from both the program and the Centre.
MAC has fully qualified pool lifeguards trained to supervise the pools and to act in the event of an emergency. MAC Pool Lifeguards are not babysitters; at all times, your child is your responsibility
To maintain the highest standards of pool surveillance, Council uses AI-powered drowning technology to support lifeguards in detecting potential drowning incidents.
The personal information requested on this form is being collected by Maribyrnong City Council for the purposes of administration and marketing of the Maribyrnong Aquatic Centre’s core business activities. The information will be used by Council for these primary purposes or related purposes. Council may not be able to provide a service as a consequence should this information not be provided. Council may disclose personal information to third parties and service providers where necessary for us to provide our services to you including payment processers, emergency services or other medical providers required to treat, transport or otherwise assist you or your dependent in the event of a medical emergency. The information provided will not otherwise be disclosed unless required or authorised by law.
Additionally, Council uses AI-powered drowning technology at the MAC supplied by Lynxight Limited to support lifeguards in detecting drowning incidents. In limited circumstances, this tool may capture personal information of swimmers and people at the MAC using video cameras installed as part of this solution. This personal information will be accessible by Lynxight in order to perform its drowning detection services. More information regarding the use of Lynxight at the MAC can be found here. If you do not wish to be captured by the Lynxight tool, please do not enter the MAC. I understand that Management and its officers, servants, employees and agents shall be released from and shall not incur any responsibility or liability whatsoever for any accident or injury to the applicant or for damage or loss of property. I hereby authorise MAC employees to organize medical or hospital treatment as they see necessary at my expense.
I acknowledge that I have received, understood, and agreed to the terms and conditions, in full, that have been presented at the time of enrolment.
