Amendment C159 - Corrections to Public Parks and Recreation Zones
Current status: The Amendment was approved by the Minister for Planning and has been gazetted.
There are different types of zones for various land uses around the City (such as commercial zones, residential zones, open space etc). These zones specify how the land can be used and what permits are required under the Maribyrnong Planning Scheme.
Amendment C159 corrects inconsistencies for 25 sites where the existing zone did not reflect the existing or intended use of the land. These inconsistencies included private land with existing residences in a Public Park and Recreation Zone (PPRZ), and existing parks zoned for residential use. Amendment C159 rezoned these 25 sites to the appropriate zones that makes them formally the same as their existing use. The Amendment did not introduce new policy and was routine and administrative in nature.
About the Amendment
The Amendment amended the Maribyrnong Planning Scheme by:
- Amending the "Land Use Framework Plan" in Clause 21.03 (Council Vision) and "Settlement Framework Plan" in Clause 21.04 (Settlement) to update the open space areas.
- Rezoning land from General Residential Zone 1 (GRZ1) to PPRZ. These sites were in the GRZ1 but are public open space reserves. The Amendment rezoned them to PPRZ in accordance with their existing use.

- Rezoning land from Neighbourhood Residential Zone 1 (NRZ1) to PPRZ. The Bellairs Park Reserve was in the NRZ1 but it is a public open space reserve. The Amendment rezoned it to PPRZ in accordance with its existing use.
- Rezoning land from PPRZ to GRZ1. These sites were in the PPRZ but are residential properties. The amendment rezoned them to GRZ1 in accordance with their existing use.

Current Status
On 9 August 2021 the Minister for Planning approved Amendment C159 to the Maribyrnong Planning Scheme. The Amendment was then gazetted on 27 August 2021, brining changes to the Maribyrnong Planning Scheme into effect.
Prior to approval and gazettal, on 15 June 2021 the Amendment was considered by Council at its Ordinary Council meeting. Council considered the submissions and resolved to adopt the Amendment. The Council report may be downloaded below.
