Building Services is responsible for the administration and enforcement of the Building Act 1993 and the Building Regulations 2018.

Section 30:Lodgement of Building Permits

The Building Regulations 2018 require Private Building Surveyors to lodge all building permits with Council within seven days of issue.

Payment of Fees

Payment of the prescribed fees is required in full and are non-refundable, at the time of submitting building permits via the online form above.

When making payments please ensure you note the reference number as this will be required when submitting additional information and final certificates.

Submission of Additional Information and Final Certificates

Additional information and final certificates can be emailed to buildingenquiries@maribyrnong.vic.gov.au where the total file size is under 30MB.

Where the total file size exceeds 30MB, please forward your information via Council's Sharefile account.

Note: Building permit must be lodged and fees paid in accordance with section 30 of the Building Act 1993.

Report and Consent for Part 5 Siting

Apply online to seek Council approval Siting matters pursuant to Part 5 of the Building Regulations 2018.

Before you commence

You will need electronic copies of the following to submit your application:

  1. Application fees - Each regulation is assessed individually, the fee is per regulation.
  2. Completed Application Form - Ensure the form is fully completed, signed and dated and that all required documentation has been collected and attached to the application.
  3. Certificate of Title - A current Certificate of Title, including a Plan of Subdivision and any Covenant details (not exceeding 12 months old) is included.
  4. Site Plan & Site Analysis - A plan of the subject allotment and adjoining properties showing all boundaries and setbacks, easements, existing building(s), proposed works and a north point, the location of habitable room windows, private open space, secluded private open space relevant elevations and sections
    appropriately dimensioned.
  5. Architectural Drawings - Drawings should be of a scale not less than 1:100. Drawings are to be sufficiently marked up/highlighted to show the location and extent of non-compliances for each regulation for which variation is sought.
  6. Signed Plans and Comments from Affected Adjoining Owners and Council’s Form - Council may require the applicant to provide comments and plans are to be designed and dated by the affected adjoining property owners, agreeing or disagreeing with the proposed application. Please use Council’s ‘Letter of
    Consent from Adjoining Owners Form.
  7. Reasoning/Justification for Application - A detailed written response addressing the applicable decision guidelines contained within the Minister’s Guideline 12 (June 2006) must accompany each application. Seek verification from your appointed Building Surveyor the specific Part 5 Building Regulations including the level of variation that is sought in this application.

Report and Consent for Building Over Easements

Apply online to seek Council approval to build over an easement pursuant to Regulation 130 of the Building Regulations 2018.

  2. Copy of the registered plan of subdivision clearly indicating the location and size of easement/s
  3. Architectural and structural drawings of proposed building works
  4. Written approval from the relevant authority (example Greater Western Water /Melbourne Water/Powercor)
  5. Legal agreements to be signed by owners (it may be necessary in some circumstances for the land owner to enter into a Section 173 Agreement to be registered with the Victorian Land Titles Office for a caveat to be placed on title)

Report and Consent for Protection of the Public

Apply online to make application to Council for report and consent pursuant to Regulation 116 of the Building Regulations 2018.

  • details of the type of hoarding or gantry proposed such as sections, elevations, fixing details.

  • Building Permit/s or CFI/OP issued in the last 10 Years
  • Current Notice or Order issued by the Relevant Building Surveyor under the Building Act 1993
  • Details of any statement issued under Regulation 64 (Combined Allotments) or Regulation 231 (Subdivision of Existing Buildings) under the Building Regulations 2018

Property Information Request - Regulation 51 - Part 2

Includes details of the following:

  • Areas liable to flooding (Reg.153)
  • Designated area in which buildings are likely to be subject to attack by termites (Reg. 150)
  • Designated area subject to significant snowfalls (Reg. 152)

Application for Adjoining Property Owner Details

Apply online to request owner details for serving of;

  • Protection Works Notice pursuant to Section 84 of the Building Act 1993; or

Request for Building Permit Plans and Documents

Apply online to request building permit plans and documents pursuant to Regulation 50 of the Building Regulations 2018.

This application is for building permit files only. If you need planning documents, you will need to complete a separate application and apply to the Planning department.

Applications on behalf of an owner will need to be accompanied by a letter of authorisation and a copy of the owners’ photo identification (driver licence, passport etc) must be attached.

Please note:

  • The fee for plan and document retrieval is a non-refundable administration fee.
  • There is no guarantee that plans will be available.
  • A search for building plans can take a minimum of 15 working days from the time application and payment is received.
  • For multi-unit residential or commercial development, owners’ corporation consent is usually required.
  • All archive documentation is sent to the department in electronic format and will be sent to you by email.
  • We cannot provide hard copies of files.

Road and Footpath Occupation - Hoarding/Gantry for Building Work

Apply online to obtain a road and footpath occupation permit pursuant to Maribyrnong City Council’s General Purpose Local Law 2015.

  • Public liability insurance policy - certificate of currency for $20 million cover
  • Site photo of the area to be occupied
  • Site plan - include dimensions, location of the precautions, all street furniture and obstructions, street signs, poles, litter bins, bus or tram stops, street trees, hydrant upstands, drains and utility pits
  • Safe Work Method Statement for demolition, asbestos, powerlines, plant, drops and falls etc.
  • Planning permit/Section 29A, endorsed drawings and the Construction Management Plan
  • Notification letter - provide a copy of a courtesy letter to be distributed to effected properties
  • Consent letter - provide a letter of consent from any properties who will lose access
  • Relocation plan for the relocation of any Council assets (note: this is at the full cost of the applicant)

Road and Footpath Occupation - Mobile Crane/Concrete Pump for Building Work

Apply online to obtain a permit to operate a mobile crane and/or concrete pump within the street reserve pursuant to General Purpose Local Law 2015.

  • Lift plan showing the jib arc, stabilisers, where the materials will be delivered from and to
  • Copy of protection works notice if the crane is lifting above any adjoining properties
